What are general terms and conditions?

General terms and conditions are practically indispensable for every company. General terms and conditions are pre-formulated conditions of the contract, which are provided by one contracting party (the user) to the other party upon conclusion. You can attach the pre-formulated conditions to any of your quotation or contract and you do not have to renegotiate the conditions each time. You thus achieve better security for your services and avoid many ambiguities and disputes.

If no general terms and conditions are agreed, the legal regulations apply. However, with AGB you can regulate many things to your advantage and adapt them to the needs of your company, such as the bearing of the delivery costs, the delivery time, the payment dates, etc.

You can strengthen your negotiating position with your own terms and conditions

Especially for small and medium-sized companies it can be difficult to refuse the general terms and conditions of large companies or groups. However, if you have your own terms and conditions, many large companies will agree to negotiate them on a case-by-case basis (at least on certain points).

 You can use AGB to steer the dispute in the right direction

Should disagreements arise, you can generally specify in the general terms and conditions for all your contracts which law is to be applied, which is particularly important in connection with foreign business partners. You can also specify how the dispute is to be settled (through prior mediation, state or private legal proceedings).
