What is a trademark?
Legally, a trademark is a protected sign that distinguishes a company’s products or services from those of other companies. All graphical representations of a sign can, in principle, be a trademark within the meaning of the law such as words, combinations of letters, numbers, graphic images, three-dimensional forms, slogans, combinations of these elements or even sound trademarks, which are made up of a sequence of notes.
Why shall I protect my trademark?
Trademarks are registered on a first come first served basis. So apply to register your trademark as soon as possible to stop somebody else pre-empting you and making it impossible for you to continue your business activities. Only a registered trademark gives you optimum protection.
National Trademark Protection
The trademark protection is limited to Switzerland. In other countries your trademark may be registered and used by third parties.
Lower Fees for national Protection
The official application fees of the Swiss Trade Mark Office are 550 CHF for an application in up to 3 classes and 100 CHF for each additional class.
Extension of trademark protection possible
Your trademark is protected from the date of filing for ten years. Protection can then be renewed indefinitely for 10 years at a time. The renewal fee (for 10 years) costs CHF 700.
EU-wide Trademark Protection
Trademark protection extends to the entire territory of the EU. This means you can enforce your trademark in Switzerland and all 28 EU member states.
Higher Fees for EU-wide Protection
An extension of the Swiss trademark in the EU results in additional fees of 1,769 CHF for an application in up to 3 classes and 164 CHF for each additional class.
Extension of trademark protection possible
Your trademark is protected from the date of filing with the Swiss authorities for ten years. Protection can the be renewed indefinitely for 10 years at a time. The renewal fee costs 1,769 CHF.
